                   	     ORDINANCE NO. 10235
                  
                  
                   AN ORDINANCE CLOSING AND ABANDONING AN ALLEY
                   LOCATED SOUTHEAST FROM GREENWOOD AVENUE,
                   BETWEEN EAST 16TH STREET AND EAST 17TH STREET,
                   MORE PARTICULARLY DESCRIBED HEREIN, SUBJECT TO
                   CERTAIN CONDITIONS.

              	   SECTION 1.  BE IT ORDAINED BY THE CITY COUNCIL OF THE
         CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby
         abandoned an alley located southeast from Greenwood Avenue,
         between East 16th Street and East 17th Street, more 
particularly
         described herein, and as shown on plat attached hereto and made 
a
         part hereof by reference:
               
                A 10 foot wide alleyway beginning on the southeast
                line of Greenwood Avenue 145 feet southwest of the
                intersection of the southeast line of Greenwood
                Avenue with the southwest line of East 16th Street,
                and extending southeast 300 feet between parallel
                lines, and parallel to East 16th Street, to the
                northwest line of Highland Park Avenue.  Said
                alleyway separates lots 53, 54, 55, and 56,
                McClung's Addition to Chattanooga, as shown by plat
                of record in deed book E, volume 2, page 255, ROHC,
                from lots 37, 38, and part of 39, said McClung's
                Addition, and lots 1 and 2, W. T. Alsobrook's
                Subdivision, as shown by plat of record in plat
                book 7, page 39, ROHC.  Tax Map No. 146P-L-8-11,
                14, 15, and 18-21.

              	   SECTION 2.  BE IT FURTHER ORDAINED, That this closure
         and abandonment is made subject to the following conditions:
                  
                1. The reservation for the Tennessee-American Water
                   Company of an easement the width of the
                   right-of-way for the purpose of operating and
                   maintaining their facilities located within the
                   right-of-way.
               
                2. The City of Chattanooga has a sewer located
                   within said right-of-way and reserves an
                   easement the width of the right-of-way for the
                   purpose of maintaining said sewer.
               
                3. The areas reserved for utility easements must be
                   kept free and clear of all structures.
               
                4. All existing easements are retained.
                  
              	  
              	   SECTION 3.  BE IT FURTHER ORDAINED, That this 
Ordinance
         shall take effect two weeks from and after its passage as 
provided
         by law.
